These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Permit Genie (“Permit Genie,” “we,” “us,” or “our”), including permitgenie.co (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Permit Genie is an AI-powered research and workflow platform for real estate permitting. The Service can analyze a property address, generate permitting roadmaps, estimate costs and timelines, prepare document checklists and application drafts, review uploaded documents, and connect you with licensed professionals through our marketplace.

Permit Genie provides informational tools only. It does not provide legal, architectural, engineering, or other professional advice, and it is not a substitute for consulting your local permitting authority or a licensed professional. Outputs are generated in part by artificial intelligence and may be incomplete, outdated, or incorrect. Permitting rules change frequently and vary by jurisdiction. You are responsible for verifying all information — including fees, timelines, zoning determinations, and document requirements — with the relevant jurisdiction before relying on it.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use.

You retain ownership of the project information and documents you submit to the Service (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and improve the Service, including processing by the third-party AI and infrastructure providers described in our Privacy Policy. You represent that you have the rights necessary to submit Your Content and that it does not violate any law or third-party right.

5. Marketplace

Our marketplace helps you find and contact independent licensed professionals such as engineers, architects, and contractors. Professionals listed in the marketplace are not our employees, agents, or partners, and we do not endorse, supervise, or guarantee their work. License information is drawn from public records and may be incomplete or out of date — verify licensure and insurance independently before hiring. Any engagement, contract, or payment between you and a professional is solely between the two of you.

The Service, including its software, design, and content (excluding Your Content), is owned by Permit Genie and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. If you send us feedback or suggestions, we may use them without restriction or compensation.

The Service depends on third-party providers — including authentication, payments, analytics, AI models, and data sources — described in our Privacy Policy. We are not responsible for third-party services, and your use of them may be subject to their own terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PERMIT WILL BE APPROVED BY ANY JURISDICTION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMIT GENIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROJECT DELAYS, PERMIT DENIALS, FINES, OR CONSTRUCTION COSTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

You will indemnify and hold harmless Permit Genie from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service in violation of these Terms, or your dealings with professionals contacted through the marketplace.

12. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk for us or other users, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 4, 7, and 9–13) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
